Terms of Service

These Terms of Service (“Terms”) govern access to and use of myownchatbot.com and our hosted chatbot software (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

myownchatbot.com provides a software-as-a-service platform to create AI chatbots, store a customer-provided knowledge base, preview bots on a demo page, and — on paid plans — embed a chat widget on third-party websites. Optional Pro features may include image OCR (text extraction) and conversation logs.

2. Accounts

  • You must provide a valid email address and keep your login credentials confidential.
  • You are responsible for activity under your account.
  • You must be at least 16 years old to use the Service.

3. Plans, fees, and billing

  • Free: create and test chatbots on our demo environment, subject to message limits. Live embedding on your website requires a paid plan.
  • Lite / Pro: paid monthly subscriptions with higher limits and features as described on the Billing page.
  • Paid subscriptions are billed through Creem, which acts as Merchant of Record. Creem’s checkout terms and refund policies may also apply.
  • Plan limits (messages per chatbot per month) are enforced automatically. Unused messages do not roll over unless we explicitly say so.
  • We may change prices or plan features with reasonable notice for renewals.

4. Acceptable use

You agree not to:

  • Use the Service for illegal, harmful, fraudulent, or abusive purposes
  • Upload or instruct the bot with unlawful, infringing, or highly sensitive content you are not allowed to process
  • Attempt to bypass plan limits, security, or payment controls
  • Reverse engineer or resell the Service except as allowed by a written agreement
  • Use the Service to send spam or malware

We may suspend or terminate accounts that violate these Terms.

5. Your content

You retain ownership of your knowledge base, branding settings, and other content you submit (“Customer Content”). You grant us a license to host, process, and display Customer Content solely to provide the Service, including sending necessary prompts/context to AI providers to generate replies.

You are responsible for Customer Content and for complying with privacy and consumer laws toward visitors who chat with your embedded bot (including providing appropriate notices on your site).

6. AI output

Chat replies are generated by automated systems and may be incomplete or incorrect. The Service is not a substitute for professional legal, medical, financial, or other advice. You should review important answers and keep your knowledge base accurate.

7. Intellectual property

The Service software, design, and branding are owned by myownchatbot.com or its licensors. Except for your Customer Content, these Terms do not transfer ownership of our IP to you.

8. Third-party services

The Service depends on third parties (hosting, AI providers, Creem payments, analytics). Their availability and policies are outside our full control. Outages or changes at those providers may affect the Service.

9. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD (OR EUR 50 IF YOU ARE ON A FREE PLAN).

11. Termination

You may stop using the Service at any time and cancel paid subscriptions via the billing flow / Creem customer portal where available. We may suspend or terminate access for violations of these Terms or for prolonged non-payment. After termination, your right to use the Service ends; we may delete account data after a reasonable period, subject to legal retention needs.

12. Changes

We may update these Terms. Continued use after the updated “Last updated” date constitutes acceptance. If you disagree, stop using the Service and cancel any subscription.

13. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, unless mandatory consumer law in your country provides otherwise.
